Terms of use
These are the terms you agree to by playing one of our games, on the web or from the App Store, and by using this website. They cover every game we make. They are short on purpose and there is nothing hidden in them: play as much as you like, don't resell or tamper with the games, and understand that they are offered as they are. Where a game asks for money, Apple takes it and Apple gives it back.
Playing the games
You may play our games for your own enjoyment, on as many devices as you like, for as long as they are available. That permission is personal and non-exclusive, and it is not a transfer of ownership: the games, their code, their artwork, their sounds and their names stay ours.
What you may not do: sell a game, rent it, or redistribute it as your own; strip or work around a purchase; or modify a game in order to forge a leaderboard score, or to attack this site or the people playing on it. Nothing here is meant to stop you reading the page source, taking a browser build apart to learn from it, or doing anything else your local law allows whatever a licence says.
Purchases
Our games are free to download and free to start. Where a game offers something to buy, these hold:
- Apple sells it, not us. Every purchase in our games is an in-app purchase made through the App Store. The price, the tax, the receipt and family sharing are Apple's. We never see your payment details.
- What a purchase covers is described in the game itself, before you buy it, and on that game's page here. A one-off unlock is permanent and tied to the Apple ID that bought it, on every device signed in to that ID. Anything consumable — something you spend inside the game — is gone once it is spent, and that is what buying it bought.
- Restoring is free and always available, from the game's own settings. Reinstalling an app, or installing it on another device, never costs a second payment.
- Refunds go through Apple, at reportaproblem.apple.com. We cannot issue one and we cannot overrule one: if Apple refunds a purchase, the game takes back what it unlocked, which is the same rule running in the other direction.
- Our browser builds take no payment. Nothing on this website is for sale. A browser build that shows something locked points at the App Store rather than selling it.
Prices, and what sits behind a purchase, may change for future buyers. What you have already bought is not taken back.
Your scores
Scores and progress are kept on the device you set them on. Clearing your browser's site data, playing in a private window, switching browsers or deleting an app will lose them, and we have no copy to restore — the privacy page sets out exactly what is stored where. Where a game uses Game Center, those leaderboard entries and achievements live with your Apple account and survive all of that.
Leaderboards are meant to rank people who played the game. Entries produced by modifying a game, the device clock, or the traffic between them may be removed, by us or by Apple, without notice.
They are offered as they are
Our games and this website are provided "as is" and "as available", without warranties of any kind, to the fullest extent the law allows. Nothing is promised to be uninterrupted, error-free or fit for any particular purpose. A browser build needs a reasonably current browser and may not run everywhere.
The games change: levels, tuning, colours and scoring are all subject to being made better, which sometimes means made different. A browser build may be taken down, and an app may stop being updated. Where either happens, anything already bought stays yours on the devices that have it, for as long as the app runs there.
Liability
To the extent the law allows, we are not liable for indirect or consequential losses arising out of playing our games, and our total liability for any claim relating to one is limited to the amount you actually paid for it — which, for most people, is nothing. Nothing in these terms limits liability that cannot legally be limited, including for death or personal injury caused by negligence, or for fraud. Some jurisdictions do not allow certain exclusions, in which case those parts simply do not apply to you.
Children and purchases
Our games contain no user-generated content, no chat and no advertising. Some of them contain an in-app purchase. If a child uses your device, Apple's Ask to Buy and Screen Time settings are the way to control what can be bought; a purchase made on your Apple ID is made under your account.
Apple
For a game installed from the App Store, Apple's Licensed Application End User Licence Agreement also applies, and where it conflicts with these terms for that version, it wins. Apple is not a party to these terms and has no obligation to provide support for any of our apps, but Apple and its subsidiaries may enforce these terms as a third-party beneficiary. Any claim about an app itself — that it does not work, or that it infringes something — is ours to answer, not Apple's.
Changes to these terms
These terms may be updated; the date below says when they last were. Carrying on playing after a change is how you accept it. A change is not applied retroactively to take away a purchase you have already made.
Law and contact
These terms are governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, and the courts of Ontario have jurisdiction over any dispute — without taking away any protection you have under the consumer law of the place you live in. If any part of these terms turns out to be unenforceable, the rest stands.
